These general terms and conditions of sale, hereinafter 'GTC', detailed below are concluded on the one hand by the company In Cute, located at 2 rue Eugénie Legrand 75020 Paris, registered with the Chamber of Trades and Crafts of Paris under number 502 132 426 and on the other hand, by any natural or legal person placing an order with the company In Cute, hereinafter 'the customer'.

OBJECT

These General Terms and Conditions govern the contractual relationship between In Cute and the customer. The acquisition of a good through this site implies that the customer acknowledges having read, at the time of ordering, these General Terms and Conditions and declares to accept them without reservation. In Cute reserves the right to adapt or modify these General Terms and Conditions at any time. It is the customer's responsibility to keep informed of any changes. The General Terms and Conditions applicable to any order are those in force at the time the order is placed.

PRODUCTS

The products offered for sale are those described on the website of the online store of the site www.incute.fr on the day of consultation by the Internet user. These products are available for purchase within the limit of available stocks. Each product is accompanied by a description and photographs. The photographs of the products posted on this site are intended to be as faithful as possible but cannot ensure perfect similarity with the products offered for sale, particularly with regard to colors and materials. The colors rendered may vary from one screen to another. The customer acknowledges and accepts that there may be a non-contractual difference.

PRICES

The prices of the products mentioned are in Euros (€), presented excluding VAT (VAT not applicable, article 293B of the CGI). The prices indicated do not take into account shipping costs which will be charged in addition and will be indicated to the buyer during the final validation of his order unless otherwise stipulated during the order process. In Cute reserves the right to modify its prices at any time. It is understood that the price guaranteed to the buyer is that displayed on the day the order is registered.

ORDER

By confirming his order, the customer accepts all of the General Terms and Conditions and acknowledges having full knowledge of them. The act of purchase entails this acceptance and the waiver of the right to rely on his own conditions of purchase or other conditions. All of the data provided and the recorded confirmation will constitute proof of the transaction. The confirmation will constitute signature and acceptance of the operations carried out. In Cute will communicate the confirmation and the delivery time of the recorded order by sending a confirmation message to the email address that the customer has provided. In Cute reserves the right to refuse or cancel any order from a customer, in particular in the event of insolvency of said customer or in the event of non-payment of the order concerned or of a previous delivery or of a dispute relating to the payment of a previous order.

PAYMENT TERMS

The products are payable in cash on the day of the actual order. Payment for purchases is made online by secure payment by credit card, thanks to the secure platform Stripe , Shopify , PayPal on which you can pay directly with your credit card without needing a specific account, by check, cash or bank transfer. However, customers with a PayPal account are given the possibility to pay for their purchases in several installments. This service is managed by PayPal and under no circumstances can In Cute be held responsible for a transaction error. The order will only be validated after receipt and verification of payment of the order by the affiliated payment center. In the event of refusal by the secure banking payment center, the order will be automatically canceled. In Cute reserves the right to refuse any order or delivery in the event of a dispute with the buyer or total or partial non-payment of a previous order by the buyer.

DELIVERY

The delivery locations served are defined by the list that appears on the site in the scroll bar when ordering. The customer is aware that this list can be modified at any time by In Cute, but this will not impact orders already validated. The delivery time may vary depending on the products ordered, the quantity of orders and the availability of products and carriers. For products available in stock, orders are shipped on average within two to three working days, if the order is placed before noon. Unless otherwise stated, delivery is made to the address indicated by the buyer when ordering. Deliveries are provided by the services of La Poste or Mondial Relay , in accordance with their own T&Cs. In Cute declines all responsibility in the event of excessively long delivery times due to postal services, as well as in the event of loss or damage to the products ordered. The products ordered are transported at the customer's risk. In the event that one or more of the products ordered are missing or damaged, the customer must make a reservation with the carrier, at the time of receipt of the order. Ownership of the products ordered will only be transferred to the customer upon full payment of the invoiced price, which includes delivery costs.

WITHDRAWAL PERIOD

In accordance with the legal provisions in force in application of article L.121-20 of the consumer code, you have a period of fourteen days from receipt of your order to exercise your right of withdrawal from the company In Cute. The product must be returned in its original packaging, in its original condition, new, unworn, unwashed, to allow their subsequent marketing. Items returned worn, incomplete, damaged, damaged or soiled will not be refunded, exchanged or taken back. The return costs are the sole responsibility of the customer. In the event of loss or damage to the returned package, In Cute will not be able to refund the order and the customer will have to make a claim directly to their carrier. PERSONAL INFORMATION AND PERSONAL DATA

The provision of personal information collected for the purposes of distance selling is mandatory. This information is necessary for the processing and delivery of orders. Incorrect or missing information will result in the order not being validated. All information in your account is only used in the context of your business relationship with In Cute, which undertakes never to share with third parties or resell the personal information collected. Finally, your banking information is never in our possession. Transactions are entirely processed by the secure payment module of the Stripe platform. All customers paying by credit card are subject to validation checks. The dispatch of your order may therefore be delayed in the event of a problem.

WARRANTIES AND RESPONSIBILITIES

In Cute has no obligation of means for all stages of access to the site, from the ordering process to the shipment of the package or subsequent services. In Cute cannot be held liable for any inconvenience or damage of any nature, whether material, immaterial or physical, which could result from a malfunction or improper use of the products sold. The same applies to any modifications to the products resulting from the manufacturers. In Cute's liability will, in any event, be limited to the amount of the order and cannot be called into question for simple errors or omissions which could have remained despite all the precautions taken in the presentation of the products. In Cute's liability is systematically limited to the value of the product in question determined on the date of its sale and this without the possibility of recourse against the brand. In all cases, In Cute cannot be held liable for non-compliance with the regulatory and legislative provisions in force in the country of receipt.

FORCE MAJEURE

In the event of the occurrence of a force majeure event, the contract between the Customer and In Cute may be terminated by both parties. We will not be liable for the total or partial non-performance of our obligations under this contract, if this non-performance is caused by an event constituting force majeure. In particular in the event of disruption or total or partial strike in particular of postal services and means of transport and/or communications, fire, floods, natural disaster, attack, equipment failure or breakdown, or due to the actions of the buyer.

DISPUTE RESOLUTION

These online sales conditions are subject to French law. In the event of a dispute and in the absence of an amicable agreement between the two parties, sole jurisdiction is assigned to the competent courts of Paris.

INTELLECTUAL PROPERTY

All elements of the In Cute brand website are protected by copyright. All models are registered with the National Institute of Industrial Property. They are and remain the intellectual and exclusive property of its creator: Caroline Bordas. Any reproduction, exploitation, redistribution or use without authorization, for any reason whatsoever, of the elements of the site (texts, comments, photographs, visual or sound elements) used on the site www.incute.fr, and the social networks belonging to the brand, are strictly prohibited under penalty of legal action.
